Terms of Use

These Terms of Use ("Terms") form a binding agreement between you ("you" or "User") and the operators of Tricksy: AI Fantasy Chat ("Tricksy," "we," "us," or "our"). They govern your access to and use of the Tricksy mobile application, website, and related services (collectively, the "Service").

1. Acceptance of Terms

By creating an account or otherwise using the Service, you confirm that you have read, understood, and agreed to be bound by these Terms and any policies referenced herein. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, in which case "you" refers to that organization.

2. Eligibility & Age Requirements

You must be at least 13 years old to use Tricksy. If you are under the age of majority in your jurisdiction (typically 18), you may use the Service only with the involvement and consent of a parent or legal guardian. By using Tricksy, you represent and warrant that you meet these requirements and that all information you submit is accurate.

We reserve the right to refuse service, terminate accounts, or remove content at our discretion if we believe a user does not meet these eligibility requirements.

3. Accounts & Security

• You are responsible for safeguarding your login credentials and for all activity that occurs under your account.
• You must notify us immediately at [email protected] if you suspect unauthorized access to your account.
• You may not share, transfer, or sell your account.
• We may suspend or terminate accounts that violate these Terms or that are inactive for extended periods.

4. The Service & AI Content

Tricksy provides an AI-driven chat experience with fictional characters in fantasy and roleplay settings. AI responses are generated by machine learning models and are not real human communications.

• AI-generated content is fictional. It may be inaccurate, incomplete, or inappropriate, and should not be relied upon for medical, legal, financial, safety, or other professional advice.
• The characters are fictional personas. Any resemblance to real persons is coincidental unless explicitly identified as a public figure parody.
• We may modify, suspend, or discontinue features at any time without notice.

5. User Content & Created Characters

Tricksy allows you to create AI characters and submit messages, reviews, and other materials (collectively, "User Content").

5.1 Your Responsibility

You are solely responsible for your User Content and any consequences of submitting it. You represent and warrant that:

• You own or have all necessary rights to your User Content.
• Your User Content does not infringe any third-party rights, including intellectual property, privacy, and publicity rights.
• Your User Content complies with these Terms and all applicable laws.

5.2 License You Grant to Tricksy

By submitting User Content, you grant Tricksy a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, host, store, reproduce, modify, adapt, publish, translate, distribute, and display such User Content for the purpose of operating, improving, and promoting the Service.

5.3 Moderation & Review

User-created characters and content may be subject to review before becoming publicly available. We may remove, restrict, or refuse to publish User Content at our discretion, including content that violates these Terms.

6. Prohibited Conduct

You agree not to use the Service to:

• Violate any applicable law or regulation.
• Generate, request, or share content that sexualizes minors or that constitutes child sexual abuse material (CSAM). This is strictly forbidden and will be reported to authorities.
• Engage in harassment, threats, hate speech, or incitement of violence against any person or group.
• Generate content that promotes self-harm, suicide, eating disorders, or other dangerous behavior.
• Create or impersonate real public figures in a misleading or defamatory manner.
• Attempt to extract, reverse-engineer, scrape, or train other AI models using outputs from Tricksy.
• Use bots, scripts, or automation to access the Service except as expressly permitted.
• Circumvent moderation, rate limits, paywalls, or other technical protections.
• Upload malware, viruses, or any code that disrupts or damages the Service.
• Use the Service to send spam, phishing, or fraudulent communications.
• Infringe the intellectual property or privacy rights of any third party.

7. Coins, Purchases & Refunds

Tricksy offers an in-app virtual currency called Coins, which can be purchased to access premium features such as messaging certain characters, generating images, or unlocking content.

• No monetary value: Coins are licensed, not sold. They have no cash value, cannot be exchanged for legal tender, and cannot be transferred outside the Service.
• Pricing: Coin prices and the amount of Coins required for any feature may change at any time without prior notice.
• Purchases: All purchases are processed by third-party platforms (e.g., Apple App Store, Google Play). You must comply with those platforms' terms.
• Refunds: Refund eligibility is governed by the policies of the platform on which the purchase was made. Where required by applicable consumer law, you may be entitled to a refund; contact [email protected] with your purchase details.
• Forfeiture: Unused Coins may be forfeited if your account is terminated for violation of these Terms.
• Taxes: Applicable taxes may be added to purchases based on your location and local law.

8. Intellectual Property

The Service, including the Tricksy name, logo, designs, software, official characters, and all related content (excluding User Content), is owned by Tricksy or its licensors and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers ownership of any intellectual property to you.

9. License Granted to You

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or lease any part of the Service or its content without our prior written permission.

10. Third-Party Services

The Service may rely on or link to third-party services (such as AI model providers, payment processors, analytics, and sign-in providers). We are not responsible for the content, policies, or practices of those third parties. Your interactions with them are governed by their own terms.

11. Disclaimers

The Service is provided "as is" and "as available." To the maximum extent permitted by law, Tricksy disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability.

We do not guarantee that the Service will be error-free, that AI-generated content will be accurate or appropriate, or that any defects will be corrected.

12. Limitation of Liability

To the maximum extent permitted by applicable law, in no event will Tricksy, its affiliates, officers, directors, employees, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising from or related to your use of the Service.

Our total aggregate liability for any claim arising out of or relating to these Terms or the Service will not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) USD $50.

13. Indemnification

You agree to indemnify, defend, and hold harmless Tricksy and its affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to (i) your User Content, (ii) your use of the Service, (iii) your violation of these Terms, or (iv) your violation of any third-party right.

14. Termination

We may suspend or terminate your account and access to the Service at any time, with or without cause and with or without notice, including for violations of these Terms. You may also delete your account at any time by contacting [email protected] or using in-app account-deletion options. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.

15. Changes to the Terms

We may update these Terms from time to time. If we make material changes, we will provide notice through the Service, by email, or by updating the "Last Updated" date above. Your continued use of Tricksy after the changes take effect constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service.

16. Governing Law & Disputes

These Terms are governed by the laws of the jurisdiction in which Tricksy is established, without regard to its conflict-of-law principles. To the extent permitted by law, any dispute arising out of or relating to these Terms or the Service will be resolved through good-faith negotiation; if unresolved, the dispute will be submitted to the competent courts of that jurisdiction. Nothing in this section limits any mandatory consumer rights you may have under applicable local law.
